Madhya Pradesh High Court Criticizes FIR Against Minister Vijay Shah Over Remarks on Colonel Sofiya Qureshi; Orders Monitoring of Investigation

On May 15, 2025, the Madhya Pradesh High Court expressed dissatisfaction with the First Information Report (FIR) filed against BJP Minister Kunwar Vijay Shah concerning his derogatory remarks about Colonel Sofiya Qureshi.  The court, comprising Justices Atul Sreedharan and Anuradha Shukla, noted that the FIR lacked specific details about the actions constituting the alleged offenses under Sections 152, 196(1)(b), and 197(1)(c) of the Bharatiya Nyaya Sanhita (BNS).  The bench emphasized that the FIR appeared to be drafted in a manner that could lead to its quashing if challenged. 

The High Court had previously directed the state’s Director General of Police to register an FIR against Minister Shah after taking suo motu cognizance of his comments referring to Colonel Qureshi as a “sister of terrorists.”  The court described these remarks as “disparaging,” “dangerous,” and “language of the gutters,” asserting that they not only targeted the officer but also denigrated the armed forces. 

Following the court’s directive, an FIR was registered; however, the High Court found it insufficient in detailing the specific actions of the accused that would constitute the alleged offenses.  Consequently, the court decided to monitor the police investigation to ensure it proceeds fairly and without external influence. 

In response to the FIR, Minister Vijay Shah approached the Supreme Court, challenging the High Court’s order.  The Supreme Court, while agreeing to hear the plea, admonished Shah for his “irresponsible” comments and reminded him that individuals holding constitutional positions must exercise restraint, especially during sensitive times like Operation Sindoor. 

The matter continues to draw significant attention, with the judiciary emphasizing accountability and the importance of upholding the dignity of the armed forces.
