Supreme Court Hears Woman Advocate’s Allegations of Sexual Assault by Gurugram Police

On June 5, 2025, the Supreme Court of India heard a petition filed by a woman advocate alleging sexual assault and physical abuse by Gurugram police officials during a visit to the Sector 50 police station in connection with a matrimonial case.  The matter was listed before a bench comprising Justices Prashant Kumar Mishra and A.G. Masih. 

Allegations

The petitioner, a practicing advocate and Executive Member of the Tis Hazari Bar Association, claimed that on May 21, 2025, she accompanied her client to the Sector 50 police station in Gurugram.  While her client was attempting to file a complaint against his wife, police officials allegedly obstructed the process.  The advocate asserts that during this incident, two male officers sexually assaulted her, subjected her to physical abuse, and illegally detained her. 

Legal Proceedings

During the hearing, the petitioner’s counsel informed the Court that despite requesting a copy of the FIR lodged against her by the Gurugram police officials, it had not been provided.  Justice Masih suggested that a formal application could be made to the concerned Chief Judicial Magistrate (CJM) to obtain the FIR.  The Court granted time for this process and listed the matter for the next day. 

The petitioner is seeking the transfer of all cases filed by and against her, related to this incident, to an independent agency such as the Central Bureau of Investigation (CBI) or the Delhi Police.  She also demands disciplinary action against the Gurugram police officials involved in her alleged illegal detention and assault. 

Context

This case has garnered significant attention within the legal community, with multiple lawyers appearing in support of the petitioner during the Supreme Court proceedings.  The incident raises serious concerns about the treatment of legal professionals by law enforcement agencies and underscores the need for accountability and transparency in such matters.
