Punjab & Haryana HC Orders PU Students to File “No-Protest” Affidavit Pending Challenge to Policy
The Punjab & Haryana High Court has directed Panjab University students applying for admission to submit an affidavit pledging not to organise protests on campus without prior official permission. This comes amid a legal challenge questioning the validity of the policy.
The bench of Chief Justice Sheel Nagu and Justice Sanjeev Berry emphasized the tension between two fundamental rights: “If right to protest or form association under Article 19 comes in conflict with the main function of university, you have to choose between your right to protest and right to education…”
Senior Advocate Akshay Bhan, representing the petitioners, argued that while blocking academic activities may justify restrictions, the university has no authority to demand a constitutional waiver through an affidavit. He raised concerns about provisions penalizing students for allowing “outsiders” to address protests.
The Court noted the deadline for filing affidavits is July 17, 2025, and instructed that submissions would not prejudice the final decision, which is expected during the next hearing on September 4, 2025.
The petition challenges clauses requiring prior written permission for protests and banning uncertain “outsiders,” as students argue these restrictions stifle academic freedom and democratic expression. The University counters that past protests have disrupted campus operations, justifying tighter controls.
