“Shocking” Demolitions Within 24 Hours: Supreme Court Strongly Reprimands UP Govt, Orders Reconstruction

The Supreme Court has expressed profound shock and dismay over the Uttar Pradesh (UP) government’s demolition of houses within 24 hours of issuing notices to residents. A bench comprising Justice Abhay S. Oka and Justice Ujjal Bhuyan strongly reprimanded the state government, deeming the actions “shocking” and “unacceptable.” The court has further directed the UP government to allow the reconstruction of the demolished houses.


The case pertains to the demolition of several houses in a particular area of Uttar Pradesh. The residents had approached the Supreme Court, arguing that the demolitions were carried out in an arbitrary and illegal manner, violating their fundamental rights. They claimed that they were given extremely short notice, making it impossible for them to seek legal recourse or even gather their belongings.


During the hearing, Justice Abhay S. Oka expressed the court’s strong disapproval, stating, “It is shocking that houses were demolished within 24 hours of the notice. This is completely unacceptable. What kind of procedure is this?” The court emphasized the importance of due process and the right to be heard before any such action is taken.


Justice Ujjal Bhuyan echoed these concerns, highlighting the human cost of such hasty demolitions. He noted the plight of the families who were rendered homeless with virtually no warning.


The Supreme Court bench, after hearing the arguments and examining the evidence, directed the Uttar Pradesh government to allow the reconstruction of the demolished houses. This directive is a significant relief for the affected residents, who have been struggling to find shelter and rebuild their lives.


The court also sought a detailed explanation from the UP government regarding the procedure followed in these demolitions. The bench has asked for specific information about the notices issued, the time given to the residents, and the reasons for such urgent action.


This case raises serious questions about the rule of law and the protection of citizens’ rights. The Supreme Court’s strong stance sends a clear message that such arbitrary actions will not be tolerated.


The Supreme Court stated, “We direct the State Government to allow reconstruction of the demolished houses. The state must ensure that the affected families are provided with all necessary assistance for this purpose.” The court also added, “We expect the State Government to act responsibly and follow due process in all such matters.”


The UP government has assured the court that it will comply with the order and provide all necessary assistance for the reconstruction of the houses. The government has also stated that it will cooperate fully with any further investigations into the matter.
