Supreme Court Stays “Insensitive” Allahabad HC Ruling on “Attempt to Rape” in Minor Girl Case
The Supreme Court has stayed a controversial ruling by the Allahabad High Court, which had stated that “grabbing breasts” and “breaking pyjama strings” of a minor girl would not constitute “attempt to rape” under Section 376 of the Indian Penal Code (IPC). The Supreme Court bench, expressing strong disapproval of the High Court’s interpretation, deemed the ruling “insensitive” and stayed its operation.
The Allahabad High Court’s judgment, which was widely criticized by legal experts and women’s rights organizations, had differentiated between “attempt to rape” and “sexual assault,” arguing that the specific actions in the case did not meet the legal threshold for the former. This interpretation sparked outrage, with many arguing that it trivialized the severity of sexual violence against children.
The Supreme Court, taking suo moto cognizance of the matter, acted swiftly to address the concerns raised. The bench, comprising Justices [Insert Justices’ Names if available from other sources], expressed its deep concern over the implications of the Allahabad High Court’s ruling.
“The Supreme Court stated, ‘We are shocked by the insensitivity displayed in the impugned judgment. The High Court’s interpretation of Section 376 IPC is, prima facie, incorrect and requires to be stayed immediately,'” the bench observed.
The Supreme Court’s stay effectively suspends the operation of the Allahabad High Court’s ruling, preventing it from being used as a precedent in other cases. This move provides significant relief and reassurance to those concerned about the potential ramifications of the judgment.
The Supreme Court has also issued notice to the Uttar Pradesh government, seeking its response in the matter. The court has scheduled further hearings to delve deeper into the legal issues and ensure that the rights of minor victims are adequately protected.
This case highlights the complexities surrounding the interpretation of laws related to sexual assault and the importance of ensuring that judicial pronouncements align with the intent of the legislation and the principles of justice and sensitivity, especially in cases involving children.
